حَدَّثَنَا أَحْمَدُ بْنُ سَعِيدٍ الدَّارِمِىُّ أَخْبَرَنَا حَبَّانُ وَهُوَ ابْنُ هِلاَلٍ حَدَّثَنَا مُحَمَّدُ بْنُ رَاشِدٍ أَخْبَرَنَا سُلَيْمَانُ بْنُ مُوسَى عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ مَنْ قَتَلَ مُؤْمِنًا مُتَعَمِّدًا دُفِعَ إِلَى أَوْلِيَاءِ الْمَقْتُولِ فَإِنْ شَاءُوا قَتَلُوا وَإِنْ شَاءُوا أَخَذُوا الدِّيَةَ وَهِىَ ثَلاَثُونَ حِقَّةً وَثَلاَثُونَ جَذَعَةً وَأَرْبَعُونَ خَلِفَةً وَمَا صَالَحُوا عَلَيْهِ فَهُوَ لَهُمْ. وَذَلِكَ لِتَشْدِيدِ الْعَقْلِ. قَالَ أَبُو عِيسَى حَدِيثُ عَبْدِ اللَّهِ بْنِ عَمْرٍو حَدِيثٌ حَسَنٌ غَرِيبٌ.
The Messenger of God, peace and blessings of God be upon him, said, "Whoever intentionally kills a believer is to be handed over to the inheritors of the murder victim. If they want, they may have him (1) put to death; or if they want, they may take the blood money, which is: thirty four-year-old camels, thirty five-year-old camels, and forty pregnant camels. And they have the right to whatever conciliation they agree upon (2)." Footnotes: (1)Masculine pronouns are generally used in Arabic as a means for referring to both men and women when the meaning is left general and is not otherwise specified. حَدَّثَنَا أَبُو عَمَّارٍ حَدَّثَنَا الْفَضْلُ بْنُ مُوسَى عَنِ الْحُسَيْنِ بْنِ وَاقِدٍ عَنْ يَزِيدَ بْنِ عَمْرٍو النَّحْوِىِّ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم دِيَةُ الأَصَابِعِ الْيَدَيْنِ وَالرِّجْلَيْنِ سَوَاءٌ عَشْرٌ مِنَ الإِبِلِ لِكُلِّ أُصْبُعٍ. قَالَ أَبُو عِيسَى وَفِى الْبَابِ عَنْ أَبِى مُوسَى وَعَبْدِ اللَّهِ بْنِ عَمْرٍو. قَالَ أَبُو عِيسَى حَدِيثُ ابْنِ عَبَّاسٍ حَدِيثٌ حَسَنٌ صَحِيحٌ غَرِيبٌ مِنْ هَذَا الْوَجْهِ. وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ وَبِهِ يَقُولُ سُفْيَانُ وَالشَّافِعِىُّ وَأَحْمَدُ وَإِسْحَاقُ.

حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ حَدَّثَنَا مَعْدِىُّ بْنُ سُلَيْمَانَ هُوَ الْبَصْرِىُّ عَنِ ابْنِ عَجْلاَنَ عَنْ أَبِيهِ عَنْ أَبِى هُرَيْرَةَ عَنِ النَّبِىِّ صلى الله عليه وسلم قَالَ أَلاَ مَنْ قَتَلَ نَفْسًا مُعَاهِدَةً لَهُ ذِمَّةُ اللَّهِ وَذِمَّةُ رَسُولِهِ فَقَدْ أَخْفَرَ بِذِمَّةِ اللَّهِ فَلاَ يَرَحْ رَائِحَةَ الْجَنَّةِ وَإِنَّ رِيحَهَا لَيُوجَدُ مِنْ مَسِيرَةِ سَبْعِينَ خَرِيفًا. قَالَ وَفِى الْبَابِ عَنْ أَبِى بَكْرَةَ. قَالَ أَبُو عِيسَى حَدِيثُ أَبِى هُرَيْرَةَ حَدِيثٌ حَسَنٌ صَحِيحٌ وَقَدْ رُوِىَ مِنْ غَيْرِ وَجْهٍ عَنْ أَبِى هُرَيْرَةَ عَنِ النَّبِىِّ صلى الله عليه وسلم.
